Often resulting from property settlement as part of a divorce or breakup is the need to transfer property from one party to another. Conveyancing is exactly this; the process of transferring ownership of a legal title of property to the new owner.
Our conveyancing team offers the highest knowledge of the electronic conveyancing process in South Australia having worked closely with industry associations and stakeholders to educate and create awareness for digital settlements through PEXA. We offer services including Verification of Identity, electronic lodgement, communications with PEXA and Land Services SA, preparing contracts of sale and ensuring the process of transferring legal ownership runs smoothly.
Caveats are used to protect interests in property; they are a “warning” that provides notice of a legal claim to a property and can act as a freeze to prevent any other person registering a dealing on the property, such as selling the property or encumbering the property with a mortgage.
Property caveats are commonly used during the breakdown of a relationship (marriage or de facto). A partner whose name is not on the title of the property, may want to claim an interest in a property on account of many years of financial contributions to the property in question.
